General Information for Data Subjects

Information provided herein are for data subjects on information on processing and protection of their personal data that are processed in the information system of the Notarial Office. These personal data processed at the Notarial Office are in harmony with Act No. 18/2018 on Protection of Personal Data (hereinafter referred to as „Act on PDP“).

Information provided herein meet requirement specified in Section 19 of the Act on PDP in respect of the scale of information that the controller is obliged to provide to the data subject when collecting personal data from him/her.

  1. ARERT system (in case of screening of wills in this system – made through the Chamber of Notaries of the Slovak Republic)

Period of Storing Personal Data
during notarial activity
  • during entire period of notarial activity performance,
  • after the performance of the notarial activity documents, registers and official seal of the notary shall be delivered to the competent court of first instance (in the circuit where the registered office of the notary took place)
during another notarial activity in relation to notarial activity
during special notarial activity – arbitral and mediation activity
during notarial activity as entitled person in relation to the Register of Public Sector Partners
during notarial activity as a court commissioner
  • documents are situated at the notary until the time of lawful accomplishment of the matter (excluding cases if the notary submitted them to another authority, e.g. court for the purposes of making decision on a remedy) and after processes that the notary is obliged to carry out after lawful accomplishment of the matter, documents shall be proceeded to the competent court of first instance,
  • records in relevant Dnot and N, Nz registers shall be stored during the entire period of the actions carried out by the notarial office
in case of job application and CV during the period of the selection procedure or until the withdrawal of consent with the processing of personal data

Rights of the data subject in relation to personal data protection

  • Right for access to own personal data (Section 21 of the Act on PDP)
  • Right for modification of personal data (Section 22 of the Act on PDP)
  • Right for limitation of personal data processing (Section 24 of the Act on PDP)
  • Right for withdrawal of consent to personal data processing (Section 14 of the Act on PDP)
  • Right for commencement/initiation of a procedure at the Office for Personal Data Protection pursuant to Section 100 of the Act on PDP

Rights of the data subject in relation to the protection of personal data that cannot be exercised or only in limited extent

  • Right for deletion of personal data (Section 23 of the Act on PDP)
  • Right for transferability of personal data (Section 26)
  • Right for objecting personal data processing (Section 27)

Lawfulness of requirements for the processing of personal data from data subject

Provision of personal data in the following extent:

  • Name and surname, academic title/degree,
  • Date of birth, personal number,
  • Marital status,
  • locality, address,
  • phone number, e-mail,
  • signature,
  • ID card number

is a legal requirement, i.e. under law the data subject is obliged to provide these data.

The existence of automated individual decision-making

  • In the environment of the Notarial Office no automated individual decision-making is introduced, including profiling pursuant to the Act on PDP.
